Domestic Violence and Restraining Orders in Southern California

Domestic violence cases often involve the issuing of a restraining order. If you have been issued a restraining order, you must adhere to a number of strict provisions that involve staying away from a the person who had the order issued.

How Restraining Orders Are Issued

People seek restraining orders to get immediate relief from harm or the threat of harm. The court has the ability to issue a temporary restraining order based on little more than the mere allegation of this harm.

Generally, there are two ways in which a restraining order can be issued:

  • Filing a restraining order through the court — This often occurs in conjunction with a family law case, where one spouse is ordered to stay away from another because he or she is suspected of violent tendencies.
  • Domestic violence arrest — When the police respond to a call reporting domestic violence or spousal abuse, they take the accused into custody. While the accused is in custody, he or she may be served with a court-ordered restraining order.

CLETS Restraining Orders

CLETS restraining orders can be issued after an ex-parte hearing in which the subject is not even present. The court is required to call the accused at least four hours before the hearing. However, with such little warning, it is very possible that this individual will miss the call and then be subject to the order without objection.

A CLETS order is temporary restraining order. Three weeks after it is issued, the accused is required to appear in court. At this point, the accused is given the opportunity to defend him or herself. In this court hearing it is very important to prevent the temporary restraining order from becoming permanent. A permanent restraining order can last up to three years.
