If law enforcement officials respond to a domestic dispute and determine that one party has possibly assaulted the other party, they may arrest them. However, frequently it is both parties that have been abusive or violent and only one person is arrested. This is usually the man unless the woman brandishes a weapon.

Typically it is both parties losing control and becoming violent. In some situations, we are able to obtain a dismissal. The police officers may have just made an assumption, and the reality is that the other person was the perpetrator

My office also attempts to have minimal restraints set in place if the relationship is reparable.

  • Ultimately you may be arrested on a felony charge, requiring $50,000. bail. You will be unable to return to your home since a temporary restraining order will be issued.
  • If there are grounds for the charge, then we do what we can to minimize impact on your life. This can mean seeking an alternative sentence, including counseling, community service, work release programs (CAL TRAN).
