Requirements for Dissolution in California

An individual filing for dissolution in California must have:

  • lived in the county of filing for at least three months prior to filing
  • been a resident of California for at least six months

Once an individual files for dissolution, he or she must serve the other side with papers. A judge will not sign a dissolution order until six months after the other party is served.

Types of Dissolution in California

  • Uncontested dissolution — A divorce in which both parties essentially agree on all divorce-related issues relating to property division, alimony, child support, etc. In this process, one party files for dissolution, the other party answers, and an attorney helps to work on stipulated agreements. If both parties behave reasonably, an uncontested dissolution can be much quicker and less expensive than a contested divorce.
  • Default dissolution — A divorce in which one spouse files for dissolution but the other spouse does not answer within the 30-day period. In this case, it is critical to work with an attorney to get the final judgment or explore other legal options.
  • Contested dissolution — A divorce in which parties do not agree on divorce-related issues. These cases are more time-consuming and expensive than uncontested dissolutions.
